Yotober Terms of Service. Using Yotober Responsibly

Welcome to Yotober — where families turn imagination into audio magic. By using our services, you agree to the terms below. Please read them carefully.

1. Who We Are

Yotober ("Yotober", "we", "our", "us") is a Canadian company based in Ontario. We provide a platform that enables parents, educators, and creators to generate and publish safe, imaginative audio content to smart speakers and other connected devices.

2. Who Can Use Yotober

You may only use Yotober if you:

  • Are at least 18 years old
  • Are a parent, guardian, teacher, or authorized adult supervisor
  • Create an account using accurate and truthful information
  • Agree to comply with these Terms

Children under 18 may use Yotober only under direct supervision of an adult account holder.

3. Your Responsibilities

As an account holder, you agree to:

  • Use Yotober for lawful, child-appropriate purposes only
  • Keep your login credentials secure
  • Monitor any content created by or for children
  • Not upload or publish anything harmful, offensive, or infringing
  • Respect copyright laws and the rights of others

We reserve the right to suspend or terminate your account if you violate these terms or applicable laws.

4. Content Guidelines

You retain ownership of any content you upload, create, or generate using Yotober. However:

  • You grant us a limited license to store, process, and publish your content to smart speakers or other approved outputs, as directed by you
  • You confirm that you have the rights (including parental/guardian rights) to upload or submit any content, including recordings of minors
  • You agree not to upload content that is violent, discriminatory, adult-themed, illegal, or otherwise harmful to children

We may review or remove content that violates our policies.

5. AI-Generated Content

Yotober provides access to AI-powered tools for generating stories, illustrations, and audio. You understand and agree that:

  • AI responses may sometimes be inaccurate or imperfect
  • You are responsible for reviewing and approving any AI-generated content before publishing
  • Some prompts or content may be sent to third-party AI providers (e.g., OpenAI, Google Cloud, ElevenLabs) for processing
  • These providers may retain or use data submitted for model training or tuning, subject to their own privacy terms

⚠️ Use of AI tools implies consent to share input data with these external vendors beyond Yotober's direct control.

6. Subscription and Billing

Yotober is a paid subscription service. By subscribing, you agree to:

  • Pay applicable fees as outlined on our pricing page
  • Allow us to charge your payment method on a recurring basis unless canceled
  • Provide accurate billing information
  • Cancel anytime to avoid future charges; refunds are not guaranteed

Failure to pay may result in suspension or termination of your access.

7. Smart Speaker Integration

By connecting your smart speaker (e.g., Amazon Alexa, Google Assistant, Yoto Player), you acknowledge:

  • We do not control or monitor your device beyond delivering content you explicitly choose to publish
  • Any personal data shared through these devices may be subject to third-party device policies
  • You are responsible for managing speaker settings and content visibility in your household

8. Privacy & Child Safety

We take child safety seriously. Please review our:

You agree not to use Yotober to collect, share, or exploit children’s data or content without full adult consent and supervision.

9. Termination

We reserve the right to suspend or terminate your access to Yotober:

  • If you violate these Terms or applicable laws
  • If you misuse the platform (e.g., upload harmful content, attempt to hack or scrape the system)
  • If required by law enforcement or child protection authorities

You may cancel your subscription at any time. Termination does not release you from outstanding payment obligations.

10. Disclaimers

Yotober is provided “as-is” without warranties of any kind. We do not guarantee:

  • That AI content will be accurate or appropriate
  • That the service will be uninterrupted or error-free
  • That data processed by third parties (e.g., AI vendors) will never be misused

We are not responsible for actions taken by third-party providers outside of our contractual agreements or technical control.

11. Limitation of Liability

To the fullest extent permitted by law, Yotober shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of content, profits, or data
  • Content created or shared by users or AI tools
  • Use of third-party integrations, including smart speaker devices

If we are found liable, our total liability shall not exceed the amount you paid to us in the 6 months prior to the event giving rise to the claim.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada, and any disputes shall be resolved in the courts of Toronto, Ontario.

13. Updates to These Terms

We may update these Terms from time to time. We’ll notify you of major changes via email or in-app notifications.

Continuing to use Yotober after an update means you accept the new Terms.
